Term Of Service & Acceptable Uses Policy

IDWEBHOST costumers have to read, comprehend and accept the following agreements before deciding to use IDWEBHOST service. On the contrary You have to obey this agreement as long as you become our client, including your replacement and permitted replacement.

This agreement is made for the shake of common interest, safety and convenience of IDWEBHOST customers.

Leasing are not allowed to :

  1. Using IDWEBHOST server for activity which against with law in Republic Of Indonesia or specified law in residence territory of jurisdiction or international law. IDWEBHOST is irresponsible of customers’ site content, Customers hold fully responsible of their sites’ content (including username & password).
  2. Saving file or content which intentionally or unintentionally consist of :
    • Mp3 Files
    • Pirated software
    • Plagiat Software/Website
    • Hackers & Phreaking program or archives
    • Warez Sites
    • IRC Bot, BNC, Egg Drop, etc
    • Sites that against copyright
    • Using IDWEBHOST server for porn/adult site
  3. Using IDWEBHOST server to run background process (continuously runs in server). For example: IRC BOT, Wget, Java Chat Server & etc.
  4. Attempting to sabotage, enter, multiply, replace data and system in IDWEBHOST server which isn’t the authority of the customers or doing something which is categorized violating IDWEBHOST’s system.
  5. Attempting to sabotage, replace data and system of other person’s server using IDWEBHOST server.
  6. Sending Spam E-mail (E-mail which consist of offering goods or service, promotion, affiliation, MLM or all kind activities that disturb other person or IDWEBHOST) which aren’t expecting by other person either using IDWEBHOST server or others. Website which invites SPAM isn’t allowed to have hosting in IDWEBHOST.

    If the customers break the rule, IDWEBHOST will directly block the customers’ accounts without previous information and the customers have to sign written agreement which states that the customers won’t repeat it again and are ready to be acted by Indonesian law. If the customers don’t respond this warning in two weeks, IDWEBHOST will close the customers’ accounts.
  7. Selling web space, free e-mail forward/POP3/Auto responder, sub domains, etc to other person without IDWEBHOST’s written permission.
  8. Using false credit card or stolen credit card.
  9. Using IDWEBHOST’s website contents without permission include texts, images, or other files.

 

COSTUMERS’ OBLIGATION

If these following obligations can not be fulfilled, you won’t be accepted as our costumer :

  1. Obeying IDWEBHOST’s rules.
  2. Responsible to do set-up or make configuration at their equipments for accessing service.
  3. Registering active e mail address to IDWEBHOST customer database, because all information about your account, debt claim, announcement and others will be addressed to that e mail. If you change your e mail address, you have to up date it to IDWEBHOST customer database by yourself.
  4. Checking the e mail from IDWEBHOST or other related companies every three days and must read it (announcement, debt claim, etc). IDWEBHOST doesn’t send the debt claim and other information by fax, SMS, or letter.
  5. Obeying all rules and instructions from IDWEBHOST. If there is something to do with the service usage, please keep the customer website exist and accessible, such as e mail about DNS address change, contact, server removal and other instructions.
  6. Paying the service on time.
  7. Sending confirmation after doing payment and explaining the purpose of the payment. Customers must follow the IDWEBHOST’s confirmation manner.
  8. Responsible to get all licenses, permission, intellectual right or other right which might be required to use the service with own money.
  9. Responsible for all information which has been taken, saved, and sent by customer.
  10. Responsible to manage the available storage capacity so that it doesn’t exceed the allocated capacity.
  11. Obeying all rules and terms in IDWEBHOST. Hal-hal yang belum ditetapkan di halaman ini akan ditetapkan di lain waktu.

 

Special Terms

MEMBERSHIP AND PAYMENT SYSTEM :

  1. IDWEBHOST has right to deactivate the customer’s account if the payment receipt hasn’t been accepted by IDWEBHOST.
  2. The money which has been paid to IDWEBHOST can’t be refund if the customer cancels the contract unilaterally. All cost which has been determined by IDWEBHOST must be fully paid by the customer. Postage expense, tax, invoice delivery and other things that beyond our service facility will be charged to the customer itself.
  3. If the customer wants to resign from IDWEBHOST service, the customer must inform the IDWEBHOST billing department before the due-date of that month. If there is no resign information from the customer, the customer monthly payment considered as usual, and the customer must pay those debts.
  4. IDWEBHOST has right to delete all site contents which have debt more than one month and no compensation for all missing data or any kind of loss caused by that deleting.
  5. IDWEBHOST has right to hold the customer’s domain name transfer/change that still has finance obligation.
  6. If there is any staff or admin replacement, customer must change/replace data in our customer database (customer automation) and domain manager (WHOIS information). If you find any problem on changing those data, please call our customer service (the replacement request must be sent by e mail which has been registered in our database). This is for avoiding undelivered announcement and domain extension information.

  8. IDWEBHOST is irresponsible for customer’s credit card claim because our staff will not ever ask or save your credit card information. IDWEBHOST doesn’t accept any complain about your credit card, for example: your domain registrar duns more than the price which is determined in our site.
  9. IDWEBHOST can’t accept you as customer if your domain name has ever been used in IDWEBHOST and still has finance obligation/debt. That domain name will be accepted if you have finished that debt. In this case, we just recognize the domain name not the name of the account/domain owner.
  10. IDWEBHOST has right to sign out the contract unilaterally if the customer has bad attitude or impolite behavior that against norms.
  11. IDWEBHOST has right to ask compensation if customer or ex customer intentionally disgrace/insult idwebhost name in mass media, mailing list, etc.
  12. IDWEBHOST has right to reject customer’s request to show idwebhost data which are not the customer’s right.
  13. IDWEBHOST as right to stop service unilaterally if the customer’s domain name and site content consist of matters pertaining to ethnic, religious, and racial relations.
  14. IDWEBHOST has right to include the costumer website address in our costumer list which actually will be advantageous for the customer since the website will have visitors/traffic from our customer list.
  15. IDWEBHOST will not return the rental money if there is any accident, chaos or undesirable incident that beyond our authority.

 

DOMAIN NAME REGISTRATION :

  1. Domain name that has been chosen by costumer can not be replaced with other domain names in the same account. If the costumer wants to change the domain name, the costumers should make new account for that new domain name. one (1) account only for one (1) domain (except re-direct domain).
  2. Costumer will not blame IDWEBHOST if the domain name that has been ordered has been bought by another costumer before we register it (in the same day).
  3. Customer as the owner of domain is obliged to obey the regulations which have been determined by pertinent Domain Registrar, for example about usage of domain, WHOIS information, renewal method, and etcetera. IDWEBHOST only assists the customer of registering the domain name to Domain Registrar, all loss or risk caused by the Domain Registrar is beyond IDWEBHOST responsibility.
  4. Costumer has full responsible of WHOIS information (contact person and the addresses) that have been filled by costumer it self. Costumer is prohibited to abuse “owner/registrant contact”, “administrative contact”, and “billing contact”. For example uses the other person name and address without permission.
  5. For the costumer that uses .id.is obliged to use IDWEBHOST email address as Administrative and Technical contact. This Matter is to make easier of changing our costumer DNS address if suddenly happen replacement of server, so that customer website downtime can minimized.
  6. IDWEBHOST gives access to the costumers to change the domain name information on line. But IDWEBHOST can’t give our user id and root registrar password, because those things are the user ID and account password that we use to register other IDWEBHOST’s customers.
  7. All cost or loss caused by third person, like domain registrar (a company where the customer’s domain name is registered) is customer responsibility. For examples: invoice and domain name extension, invoice caused by domain name modifying or changing, DNS address changing after server replacement, a mistake payment confirmation from domain registrar on payment or domain name extension, expired/invalid domain name of our customer, failed domain name debt claim e mail from registrar to our customer mail box, error at domain name and others that are connected with customer’s domain name.

 

DOMAIN NAME EXTENSION :

  1. Domain name extension is customer own duty and responsibility. If there is no previous information about customer resignation, the customer still has to do hosting monthly payment even though the domain name has been expired. The domain name extension must be done two months before expired/due-date. IDWEBHOST is irresponsible for fine/loss caused by over due-date payment, since IDWEBHOST just assists on registering, processing, and extending the domain name customer to domain registrar.
  2. Customer isn’t allowed to change "Owner/Registrant Contact", "Administrative Contact" and "Billing Contact" with IDWEBHOST name and e mail address, since all information like domain extension, etc, will be sent to those addresses (customer). Customer is fully responsible on domain extension and doesn’t have right to use IDWEBHOST name and email address on that contact and burdens the domain extension to IDWEBHOST.
  3. According to domain registration regulation ICANN, if your domain name has been expired more than 30 days, registrar (Reseller ICANN) will return your domain name to Registry so that your domain status becomes "REDEMPTIONPERIOD" Registry will hold that domain name until available. During that time, IDWEBHOST can’t help you to extend and doesn’t have any responsibility on monitoring it.

 

The offense of the rules and regulation above, IDWEBHOST will be :

  1. giving warn once and also fine USD 50.  
  2. If the costumers ignore the first and the second warning and still offense, IDWEBHOST will stop the service unilaterally to customer without return the money.

If customers have registered in IDWEBHOST order form and been accepted as IDWEBHOST customers, all the regulations above are applied to those customers
